Legal information on renting out

The following information summarises the key legal framework in plain language and does not replace individual legal or tax advice.

When you offer your parking space, the contract is concluded directly between you (the landlord) and the parking person (the tenant), usually a rental agreement under Section 535 of the German Civil Code (BGB). anny acts solely as an intermediary and provides the booking platform, so it does not become a contracting party itself. The key rules are set out in the booking terms, which are accepted with every booking.
Yes. Income from renting out a private parking space generally counts as income from letting and leasing (Section 21 of the German Income Tax Act, EStG) and must be declared in your income tax return. The exemption limit for occasional rentals of €256 per year (Section 22 No. 3 EStG) expressly does not apply to the regular renting of parking spaces. In return, you can deduct related expenses (e.g. depreciation, maintenance, administration) to reduce your taxable income.
Even as a private individual, you may under certain circumstances, for example with short-term, intensive renting, be classified as a commercial business for tax purposes. In that case, trade tax and VAT (standard rate 19%) may additionally apply. If your total turnover is below the small-business thresholds (€22,000 in the previous year / expected €50,000 in the current year, Section 19 of the German VAT Act, UStG), no VAT is charged. The overall picture is always decisive, and when in doubt, professional tax advice is worthwhile.
Only with consent. If you offer a parking space that you do not own but, for example, rent yourself, you must check beforehand whether your landlord or the owner has given their consent. Without this permission, you may not sublet the space.
No. Only private parking spaces may be rented out via the platform, not public traffic areas. Suitable proof includes, for example, a land register extract or a rental agreement. Anyone who falsely offers a public area as a private parking space risks a contractual penalty; in addition, the public authority can demand cessation (Section 1004 BGB) and reclaim the unlawfully obtained rent (Section 812 BGB).
If the parking person exceeds the booked time, you can charge for the additional parking duration, the basis includes the claim for compensation for use (Section 546a BGB); further damages can be claimed under Sections 280, 823 BGB. So that enforcement in minor cases does not become a burden for you, the claim can be assigned to the platform (Section 398 BGB), which then takes it over.
Yes. If a vehicle is parked on your space without authorisation after the booking has ended, you have a claim to have it removed and to be reimbursed for the customary local towing costs (including agency without specific authorisation, Sections 683, 677, 681 BGB as well as Section 823 (2) in conjunction with Section 859 BGB). This claim can also be assigned to the platform or the towing company.
No, guarding or safekeeping of the vehicle is expressly not part of the rental; you only owe the provision of the parking space. However, please note that as a space provider you are subject to the usual traffic safety obligations, in particular the clearing and gritting duties under the municipal snow and clearing bylaws.
If the booked parking space is locked, occupied or inaccessible and you are responsible for this, the parking person can claim the additional costs for a replacement parking space from you (Section 536a BGB) or reduce the rent (Section 536 BGB). Therefore, only release times that are actually available.
The City of Aachen can activate a so-called residents' protection scheme (Anwohnerschutzkonzept) in individual neighbourhoods, for example during major events such as Alemannia Aachen's home games around the Tivoli stadium. This creates restricted zones (Sperrzonen) that only residents with a valid resident parking permit may drive into, while external visitors, and therefore your renters, are not allowed to enter. If your parking space lies within such a restricted zone, it cannot be reached by external drivers during these periods and must therefore not be offered while the zone is active. Block the affected times in the app and only release periods in which your space is genuinely accessible. Once the restricted zone is lifted, you can rent out your space as usual. The specific zones, periods and rules are defined by the City of Aachen and may change, so stay informed about the current situation in your neighbourhood.
